WAIVER PROCESS
The year 2013 began bringing good news to the immigrant community in the United States.

​

On January 2nd Secretary Janet Napolitano announced the final rule that reduces the time that citizens are separated from their immediate relatives (parents, spouses and children) who entered illegally and are in the process of obtaining a visa to adjust their current immigration status in the U.S. consulate of their home countries.

​

The final rule establishes a process that allows certain individuals to request a provisional waiver of unlawful presence and to know the results of the waiver request before leaving the United States to attend the immigrant visa interview in their countries.

​

The above process will be effective on March 4, 2013, when the eligibility criteria will be more specific and I601A form will be published.

​
